its say it has to be in battle but it effect is destroying it....so does it effect still can bring out the other lvl mts?
Yes, since it is destroyed by it's effect at the beginning of the damage step and by battle (effect on the card is applied by battle) ATEMVEGETA 06:51, 14 January 2009 (UTC)

- If "Mystic Swordsman LV2" attacks a face-down Defense Position monster, that monster is destroyed by "Mystic Swordsman LV2's effect, not as a result of battle. So you cannot use its second effect to Special Summon "Mystic Swordsman LV4" during the End Phase.
